Sharek Youth Forum to take legal action against the deposed Government in Gaza.
Due to the continued oppression it has faced since the closure of its headquarters in Gaza, Sharek Youth Forum has taken legal action against the deposed government in Gaza. This oppression resulted from the legal violations committed by deposed government which ultimately lead to the closure of Sharek Youth Forum in Gaza, and subsequent total dissolution and liquidation of all its assets.
Sharek has taken this action to show all its supporters (including civil society organizations, activists and human rights workers) that decisions made by the authorities in Gaza are a flagrant violation of freedoms, rights and illegal interference. Sharek cannot and should not be kept silenced against such acts. By doing so, these decisions discredit the whole Palestinian society and jeopardize the concepts of pluralism and democracy, which Palestinians hold dear.
Therefore, Sharek Youth Forum took the following cases to courts:
- The seizure of all Sharek’s assets and properties in Gaza strip. Conciliation Court on 25 August 2011
- The temporary closure of Sharek’s headquarters. Higher Justice Court on 27 September 2011
- The complete dissolution of Sharek Youth Forum. Pending - Higher Justice Court 13 September 2011
- Requesting the immediate re-opening of Sharek’s headquarters. Pending
Ultimately, we aim for the following to be recognized:
- The decisions taken by the deposed government in Gaza are found to be illegal and in violation with the Palestinian Law (Charitable Societies Law)
- The decisions issued by the government deliberately undermine Palestinian Law and the power of the judiciary system
We at Sharek have every confidence in the judiciary system. We believe that our case is one solely regarding the disregard of human rights and public opinion.
We believe that the judiciary system has to adhere to the Palestinian law unequivocally. Thus, the immediate re-opening of Sharek’s headquarters is a necessity – not only for Sharek but for the honor of Palestinian legal system as a whole.
